1. INTRODUCTION
Ships Afloat Travel (“we,” “us,” “our”) is a sole proprietorship travel agency operating as an Independent Affiliate of A.S.A.P. Cruises Inc. By booking travel with us, you (“client,” “traveler,” or “you”) agree to these Terms & Conditions. These Terms & Conditions apply to all bookings made with Ships Afloat Travel, whether via phone, email, online, or written authorization.
If you do not agree to these Terms & Conditions, please do not complete a booking.
2. ROLE OF SHIPS AFLOAT TRAVEL
Ships Afloat Travel acts solely as a travel agent/intermediary between you and third-party suppliers, including but not limited to cruise lines, hotels, tour operators, airlines, transportation providers, and insurance companies (“suppliers”).
We do not own, operate, or control any supplier. Each supplier has its own terms, conditions, and policies. By booking with Ships Afloat Travel, you agree to also be bound by each supplier’s applicable terms and conditions.
3. TRAVELER INFORMATION RESPONSIBILITY
You are solely responsible for providing accurate legal names, dates of birth, passport information, contact information, and any other required data.
Names must exactly match the traveler’s government-issued ID or passport.
Ships Afloat Travel is not responsible for:

denied boarding
-
fees due to name or document errors
-
itinerary changes caused by incorrect traveler information
Any fees resulting from corrections or rebooking are the client’s responsibility.
4. PAYMENT AUTHORIZATION
When submitting any credit card via our secure authorization link, you agree that:

You authorize Ships Afloat Travel and/or the supplier to charge your card for deposits, installment payments, insurance, taxes, fees, and final balances.

You agree that the person entering their card information is the authorized cardholder.

You understand that suppliers (not Ships Afloat Travel) charge most payments directly after authorization.
4.1 STRONG CHARGEBACK PREVENTION STATEMENT (Legally Protective)
By booking through Ships Afloat Travel, you irrevocably agree that:

All payments are subject to the supplier’s cancellation, change, and refund policies.

You will not file a credit card chargeback for any reason related to:
-
supplier policies
-
dissatisfaction with services delivered by a supplier
-
schedule changes, delays, or cancellations
-
voluntary or involuntary cancellations
-
pandemics, weather, or force majeure events
-
failure to purchase optional travel insurance
-
You agree that a chargeback is not an appropriate or lawful substitute for pursuing a refund through the supplier’s policies.
Filing a chargeback in violation of these Terms & Conditions constitutes breach of contract, and Ships Afloat Travel reserves the right to:

dispute the chargeback with documentation
-
recover all related costs, including attorney’s fees
-
terminate future services
5. CANCELLATIONS, REFUNDS & CHANGES
Cancellation, refund, and itinerary change policies are set by the supplier. These policies vary and may include:

nonrefundable deposits
-
cancellation penalties
-
change fees
-
no refunds after a certain date
Ships Afloat Travel is not responsible for supplier decisions regarding refunds or credits.
If you cancel your booking, you agree to pay any supplier-imposed fees. You also agree that any refund—if permitted—will be processed by the supplier, not Ships Afloat Travel.
6. TRAVEL INSURANCE
Travel insurance is strongly recommended.
Unless explicitly added and paid for, travel insurance is not included in your booking. Without insurance, you may be unable to recover costs related to injury, illness, cancellation, delays, lost luggage, or other losses.
Declining travel insurance indicates that you accept full financial responsibility for trip losses.
7. TRAVEL DOCUMENTS & ENTRY REQUIREMENTS
You are responsible for meeting all entry, passport, visa, vaccination, testing, and customs requirements for all destinations.
Ships Afloat Travel is not liable for:

denied entry
-
denied boarding
-
quarantine expenses
-
itinerary interruption due to documentation issues
Passports often require 6 months of validity beyond your travel dates—please verify early.
8. HEALTH, SAFETY & MEDICAL CONDITIONS
Travel may involve risks, including illness, injury, or death. Ships Afloat Travel is not responsible for medical care, incidents, or decisions made by foreign governments or suppliers.
You acknowledge responsibility for evaluating personal health needs and seeking medical advice prior to travel.
9. FORCE MAJEURE
Ships Afloat Travel is not liable for events beyond our control, including but not limited to:

pandemics or disease outbreaks
-
acts of government
-
strikes
-
weather events
-
war, terrorism, or civil unrest
-
natural disasters
-
supplier bankruptcy or operational failure
In these cases, refunds are controlled solely by the supplier.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law:

Ships Afloat Travel is not liable for acts, omissions, negligence, or errors of any supplier.

Ships Afloat Travel is not liable for personal injury, property damage, deaths, delays, or changes in itinerary.

Maximum liability for any claim against Ships Afloat Travel is limited to the commission earned on your booking.
You agree to waive all claims against Ships Afloat Travel arising from supplier actions, force majeure, or situations beyond our control.
11. FRAUD PROTECTION
Ships Afloat Travel reserves the right to:

request additional identification for credit card verification
-
decline bookings suspected of fraud
-
cancel reservations if payment is reversed or unauthorized
12. SELLER OF TRAVEL DISCLOSURES
Ships Afloat Travel operates as an Independent Affiliate of A.S.A.P. Cruises Inc., the registered Seller of Travel for required states:

Registration as a seller of travel does not constitute approval by the State of California.
13. GOVERNING LAW & JURISDICTION
These Terms & Conditions are governed exclusively by the laws of the State of North Carolina.
Any disputes, claims, or legal actions must be brought exclusively in the state or federal courts located in Henderson County, North Carolina.
You agree to this jurisdiction and waive any right to dispute venue or applicable law.
14. ACCEPTANCE OF TERMS
By booking with Ships Afloat Travel, submitting payment, or authorizing a credit card charge, you acknowledge that you:

agree to be bound by them

agree to be bound also by supplier terms and conditions
-
accept all liability for adherence to travel documentation requirements
If you do not agree to these terms, do not complete a booking or submit payment.
